Terms and conditions:

1. All entry instructions and prize information published by the Promoter form part of these Terms and Conditions. Entry into the Promotion constitutes acceptance of these Terms and Conditions. By entering the Promotion Entrants accept and acknowledge full responsibility for their decision to participate in the Promotion and to take a Prize if they are drawn as a Winner.
2. The Promoter is MC Dental (ABN 57 947 026 372) of Shop 254, Level 2/211 La Trobe St, Melbourne VIC 3000. Ph: 8608 8968 (Promoter).
3. These Terms and Conditions shall be governed by the laws of Victoria, Australia and any dispute shall be subject to the exclusive jurisdiction of the Australian courts.

Duration
4. Entry to the Promotion commences at 9:00am AEDT on 04/08/25 and closes at 11:59pm AEDT on 31/08/25 (Promotion Period).

Eligibility to enter
5. Entry is free and no purchase is necessary to participate.
6. The competition is open to all patients of MC Dental clinics in Melbourne (Eligible Entrants).
7. Entrants aged under 18 years must obtain the consent of their parent or legal guardian to enter the promotion. These Conditions of Entry will bind the Entrants and any parent or legal guardian who gives their consent.
8. MC Dental employees and their immediate family members are not eligible to enter the Promotion. Immediate family includes only spouses, parents and children.
9. The Promoter reserves the right, at any time, to verify the validity of Entries (including an Entrant’s identity, age and place of residence) and to disqualify any entrant who is not an Eligible Entrant, has not complied with these Terms and Conditions or tampers with the entry process.

Entry into the Promotion
10. To Enter Eligible Entrants must complete the following steps (Entry):
a. Visit https://www.mcdental.com.au/chance-to-win-jar-competition/ & complete the competition form with their details including their guess of how many items are in the jar (mini Colgate toothpastes and lip balms), full name, email address, mobile number and social media name.
b. Follow MC Dental on either Facebook or Instagram.
11. As a condition of entry, all Eligible Entrants must opt-in to receive marketing material via email and SMS from MC Dental.
12. Entrants may only enter this competition once and must enter in their own name, email address and mobile number.
13. Entries must be submitted by the Entrant, automated Entries will not be valid.
14. Obscene, provocative, or otherwise inappropriate content will not be considered. The Promoter retains sole discretion as to what constitutes inappropriate content.
15. The Promoter is not responsible for (and is under no obligation to accept) any lost, late, incomplete or misdirected entries.
16. The time of entry will be deemed to be the time the entry is received by the Promoter.

Determination of Winners
17. This promotion is a game of skill. The total number of Colgate mini toothpaste tubes plus MC Dental lip balms in the jar at MC Dental Docklands is the
“Correct Number”. The winning entry will be determined as the valid entry from all entries received which contains the Correct Number as the guess for the number of Colgate mini toothpaste tubes plus MC Dental lip balms in the jar. If there is no Correct Number that is guessed, the entrant closest to the Correct Number will win the prize.
Tie-Break Mechanic: In the event that two or more people guess the correct number of Colgate Mini Toothpaste tubes plus Mc Dental lip balms, the winner will be chosen as the tied entrant who was first to submit their entry. in accordance with clauses 18 and clause 32 (if applicable).
18. All valid Entries received during the Promotion Period will be eligible for the draw.
19. Winners will be picked at Shop 10, 677 La Trobe St, Docklands VIC 3008 by 5:00pm AEDT 16/09/25.
20. There will be a total of 1 x Winner.
21. The result of the draw is final and no correspondence will be entered into.
22. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a Winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

The Prizes
23. The Winner will receive (Prize):
The Colgate mini toothpastes and lip balms that are in the jar. A $50 gift card.
24. Total Prize pool value is RRP $50 (AUD).
25. Winners will be required to collect from their nearest MC Dental clinic.
26. Under the Australian Consumer Law, there are some warranties and guarantees that cannot be excluded, restricted or modified or can only be excluded, restricted or modified to a limited extent. The Promoter excludes all warranties and guarantees in relation to the prizes, to the extent allowable under the Australian Consumer Law. Except as otherwise required under the Australian Consumer Law, the Promoter accepts no liability or responsibility for any defect with the prizes.
27. Prizes are not exchangeable or redeemable for cash.
28. If a Prize (or part of a Prize) is unavailable for any reason, the Promoter, in its discretion, reserves the right to select an alternative prize of similar value which will be awarded to the relevant Winner, subject to any written directions from a regulatory authority.
29. The Promoter accepts no responsibility for any tax implications that may arise from the promotion or the Prizes. Independent financial advice should be sought.

Notification of the Winner
30. The Winner will be notified via the email address used for their Entry by 5:00pm AEDT 16/09/25.
31. The Winner will be announced publicly via a Facebook post through the MC Dental Facebook account once the Winner has been notified and accepted their Prize.

Right of the Promoter to redraw
32. The Promoter reserves the right to re-select a Winner in the event of a Winner not being an Eligible Entrant, not having complied with these Terms and Conditions or not being able to be contacted by the Promoter after the Promoter having made reasonable efforts to do so. If a redraw is necessary, it will be conducted at Shop 10, 677 La Trobe St, Docklands VIC 3000 on 24/09/25, subject to any written direction given under applicable law. Any Winner determined in accordance with this clause will be notified by email within 3 business days of the redraw.

Limitation of liability and variation of promotion
33. Except as otherwise required by law, if any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations. The Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend this promotion and these Terms and Conditions.
34. Except for any liability that cannot be excluded by law, the Promoter, its related bodies corporate and their respective officers, employees, contractors and agents will not be liable for any losses (including loss of opportunity), damages, expenses, costs or personal injuries arising out of or in connection with this Promotion, or the use of any Prize.

Entry details and privacy
35. If an Eligible Entrant participates in the promotion they agree to subscribe to the MC Dental email newsletter and SMS updates and acknowledge that a further primary purpose for collection of the Entrant’s personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving services and to contact the Entrant in the future with information on special offers or provide the Entrant with marketing materials via any medium including email and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future.
36. Without limiting the foregoing, entrants’ personal information provided in connection with this promotion will be handled in accordance with the Promoter’s Privacy Statement, a copy of which is available at https://www.mcdental.com.au/privacy-policy/

Third party promotion
37. This Promotion may be promoted through third party websites, like Facebook and Instagram. Entrants must at all times comply with the terms of service for those third-party websites when using them to participate in this Promotion. This Promotion is in no way sponsored, endorsed or administered by, or associated with those third-party websites.
